Here are some frequently asked questions we receive from Landlords. YOUR MOVE has answered these questions to provide a guide for landlords.

Q: Why should I use a managing agent?

A: Creates professional distance between you and your tenant. Takes the strain out of dealing with the bad bits eg rent arrears and deposit disputes. Choose one which is a member of the TPO and ARLA so can keep you up to date with current legislation and provide a redress if you are not happy with the service. Normally able to find you a tenant more quickly.

Q: What is the tenancy deposit scheme?

A: It is a legal requirement to register the tenant’s security deposit in an approved scheme.

Q: Why should I have an inventory?

A: An inventory is a detailed list of the contents and condition of your property - it is important if there is a dispute over damage at the end of the tenancy as it is your proof of the condition of the property at the start of the tenancy.

Q: Why do I need an EPC?

A: It is a legal requirement that an EPC (Energy Performance Certificate) is made available for any prospective tenant prior to viewing a property. Failure to comply can result in the landlord receiving a fine.

Q: What are the landlord’s obligations surrounding Gas?

A: Any property which has gas appliances or gas supplied to the property must have a Landlord’s Gas Safety check carried out on a 12 monthly basis by a properly qualified engineer. Further information can be found on www.gassaferegister.co.uk

Q: Why can’t the landlord go into their property during the tenancy?

A: You can, provided you give the correct notice to the tenant. YOUR MOVE’s Lettings Support team can provide detailed advice to their Landlords on this and many other lettings related topics.

Q: What is a Routine Visit?

A: This is a regular check on a property to ensure it is being looked after, with a report generated and sent to the Landlord.

Q: What happens if my tenant doesn’t pay?

A: It is sound practice for the Landlord to insure himself against non payment of rent – YOUR MOVE offers a bespoke policy which insures up to 6 months of rent and £15,000 of legal costs amongst other features at a low monthly cost.

Q: What happens if the tenant damages my property?

A: The agent should normally take a security deposit at the start of the tenancy. The Landlord can reinforce this with a specialist landlord's buildings and contents policy provided by YOUR MOVE.

Q: How can I get my tenant out?

A: Normally legal action is necessary if your tenant will not vacate when required. YOUR MOVE's Rent Indemnity Insurance will cover up to £15,000 of legal cost where there are also rent arrears.

Q: What is ARLA?

A: The Association of Residential Lettings Agents. It is the professional and regulatory body for Letting Agents in the UK. Although as membership is voluntary the majority of agents are not a member - YOUR MOVE is a member of ARLA.

Q: What is TPO?

A: The Property Ombudsman; an independent body to which Landlords can refer any complaint should the agent fail to address it to their satisfaction.

Q: Do I need to get my electrical appliances tested?

A: The law requires any electrical appliance to be safe to use although no specific test is required. YOUR MOVE recommends Portable Appliance Testing for any electrical appliance that will form part of the let.

Q: How do I check my furniture is compliant?

A: The legislation applies to all domestic upholstered furniture and furnishings. All furniture must display standard labels in a prominent position. YOUR MOVE's branch teams can advise a landlord on furniture safety legislation.

Q: Does a landlord need to pay tax?

A: All Landlords could be liable to pay tax on their rental income whether UK based or overseas. Further information can be found on the Inland Revenue’s website www.hmrc.gov.uk/index.htm

Q: Will my money be safe?

A: If your agent is a member of ARLA your money will be protected through the Protection Bonding Scheme.
